Duties Description BASIC FUNCTION: PERB ALJs act as first-level judges in the administrative labor relations framework established in New York State by the Taylor Law and State Employment Relations Law. ALJs perform the crucial role at PERB of conferencing (e.g., mediating) and, if necessary, ruling after hearing on labor and management disputes and issues. ALJ is the working title for this position. The Civil Service title is Associate Trial Examiner.

WORK PERFORMED: The ALJ prepares for and conducts prehearing conferences, assisting the parties to reach an agreement. If resolution is not possible, the ALJ will conduct a hearing. The ALJ prepares a decision in representation matters and in improper practice cases which, in both types of cases, contain a statement of the issue and relevant facts, together with a discussion and analysis of appropriate precedents. The decision becomes binding on the parties if it is not appealed to the Board. The ALJ also engages in legal research and prepares correspondence and other writings in response to inquiries received from PERB's constituents.

Minimum Qualifications Admission to the New York State Bar and six years of substantial experience in the field of labor-management law and labor-management relations primarily under the Taylor Law or similar collective bargaining laws including but not limited to experience as a neutral deciding or resolving disputes over terms and conditions of employment or representation issues or as an employer or union advocate in the adjudication and resolution of such labor-management disputes. Candidates with appropriate post-bar experience and bar admission in states with reciprocity with NYS may be considered. Candidates with bar admission in another state must obtain NYS bar admission prior to their hire date. Additional Comments This position is located in Albany, NY. Incumbents may be allowed to work up to 50% remote, depending on work demands and after initial training. Candidates under consideration will be required to attend an in-person interview in the Albany, NY offices of PERB.
