Duties Description The Associate Attorney (SG-28) is a position in the Office of General Counsel, Bureau of Minerals and Materials Management, Environmental Permitting Section.
The Associate Attorney serves as program counsel to the Division of Environmental Permits, which administers DEC’s permit management system. Principally, in that position, the Associate Attorney advises DEC staff on the requirements of the Uniform Procedures Act (UPA), the State Environmental Quality Review Act (SEQR), the National Environmental Policy Act (NEPA), and the State Administrative Procedures Act (SAPA) with respect to administrative procedure for rulemaking and hearings.

The Associate Attorney will have a basic knowledge of DEC’s major permitting programs that fall under the permit management including SPDES, the Mined Land Reclamation Act, solid waste, and air.

The Associate Attorney will advise DEP staff on legal, procedural issues related to Section 401 of the Clean Water Act (water quality certifications) and substantive areas of environmental impact review including climate change and environmental justice, in collaboration with other DEC program attorneys.

The Associate Attorney will work with DEP to develop and present guidance to all levels of government in New York and provide SEQR training to local and state government officials to help them comply with SEQR.

The Associate Attorney will help DEP staff manage the lead agency dispute resolution process for SEQR and prepare draft opinions for the Commissioner and help DEC staff review and prepare SEQR documentation including environmental impact statements and negative declarations.

The Associate Attorney will assist DEP central office and regional staff on project reviews and permit proceedings that sometimes involve hearings and litigation.

The Associate Attorney will work with DEP staff to respond to legislative issues, including drafting and responding to legislative initiative that may affect DEC’s permit management system and SEQR.

The Associate Attorney should be familiar with the Freedom of Information Law and general constitutional and legal requirements of administrative procedure.

The Associate Attorney must be available to attend statewide and regional meetings of DEP staff and timely respond to DEP staff requests for advice.

The Associate Attorney will take over a section chief position in the bureau, and manage the agency's Rule-making Coordinator, as well as a SG25 Senior Attorney position.

DEC prefers a candidate with a working knowledge of local government law and how SEQR operates within that law.

Transfer Eligible - One year of permanent competitive service at Salary Grade 26 or higher and either:

Eligible for transfer under Section 52.6: Must have current or prior service in a title designated as 52.6 within two salary grades\one M grade of this position and possess the appropriate license. To determine if your title is designated as 52.6 go to the Department of Civil Service website and search for your title under GOT-IT.
